“Company” refers to SMS Train
“Client / User” refers to any individual or company using our SMS services
“Service” refers to bulk SMS, transactional SMS, promotional SMS, APIs, dashboards, and related services
“Network Operators” refers to telecom companies involved in message delivery
You must be at least 18 years old to use our services
You must have the legal authority to bind your company (if registering on behalf of a business)
You agree to provide accurate and complete registration information
Clients are responsible for maintaining the confidentiality of login credentials
Any activity performed through your account will be deemed authorized by you
SMS Train is not liable for losses caused by unauthorized account access due to client negligence
You agree to use SMS Train services only for lawful purposes.
Spam or unsolicited messages
Fraud, scams, or misleading content
Illegal activities or services
Adult, obscene, abusive, or hateful content
Political or religious hate messages
Any content violating local or international laws
SMS Train reserves the right to suspend or terminate services without notice if prohibited content is detected.
Clients must obtain proper consent from recipients before sending SMS
Clients are fully responsible for compliance with PTA regulations and applicable international laws
SMS Train will not be responsible for penalties, complaints, or legal action arising from client misuse
Sender IDs are subject to approval by network operators
Message content may require approval prior to transmission
SMS Train does not guarantee approval or delivery of any Sender ID or message content
SMS delivery depends on network availability, operator policies, and recipient handset status
SMS Train does not guarantee 100% delivery of messages
Delayed, blocked, or failed messages are not grounds for refunds unless explicitly agreed in writing
All prices are subject to change without prior notice
SMS credits are prepaid and non-transferable
Purchased credits are non-refundable and non-expirable unless stated otherwise
Taxes or government charges (if applicable) will be borne by the client
SMS Train reserves the right to:
Suspend services for violations of these Terms
Terminate accounts involved in spam, fraud, or illegal use
Block Sender IDs or traffic without prior notice to protect network integrity
All website content, software, branding, logos, and systems are the property of SMS Train. Unauthorized copying, resale, or redistribution is strictly prohibited.
SMS Train shall not be liable for:
Indirect, incidental, or consequential damages
Business loss, revenue loss, or reputational damage
Network failures or third-party service interruptions
Total liability shall not exceed the amount paid by the client for the service in the last 30 days.
You agree to indemnify and hold SMS Train harmless from any claims, damages, penalties, or expenses arising from:
Violation of these Terms
Misuse of SMS services
Breach of laws or regulations by the client
SMS Train reserves the right to update these Terms at any time. Continued use of services after changes constitutes acceptance of the updated Terms.
These Terms shall be governed and interpreted in accordance with the laws of Pakistan.
